PRIOR HISTORY: [***1] Middlesex. Indictments found and returned in the Superior Court Department on March 17, 1993. The cases were tried before Peter M. Lauriat, J. A motion for appointment of a guardian ad litem was heard in the Appeals Court by Perretta, J., and a motion to reconsider was also heard by her.
DISPOSITION: Judgments reversed, verdicts set aside, and case remanded for evidentiary hearing concerning Simpson’s competence to stand trial and competence to conduct his own defense as to which, in each instance, an evaluation of mental responsibility may be a component. Should he be found competent to stand trial, there can be a new trial. Should he be found incompetent to stand trial, he shall be committed to Bridgewater State Hospital or another facility. For reasons stated by her, order of single justice affirmed.
